You understand that AI-generated responses, recommendations, messages, summaries, and outputs may not always be complete, accurate, appropriate, or suitable for every situation. You are responsible for reviewing, configuring, approving, monitoring, and supervising how AI tools are used in your business.

StreamlineFlow does not guarantee that AI features will produce a specific result, close a deal, book a job, prevent missed leads, increase revenue, or replace all human oversight. AI tools should be used as support systems, not as a substitute for professional judgment, legal compliance, customer service oversight, or business decision-making.

You are responsible for ensuring that your AI assistant is trained, configured, and used according to your business rules, customer expectations, and applicable laws.

You agree to use StreamlineFlow only for lawful, authorized, and appropriate business purposes. You must not use the platform to:

  • Use the platform in a way that harms StreamlineFlow, its users, partners, vendors, or reputation

We may suspend or terminate access if we believe your use creates legal, security, operational, reputational, or compliance risk.

7. Marketing, Messaging, and Communication Compliance

StreamlineFlow may allow you to send or automate messages through channels such as email, SMS, phone, chat, WhatsApp, website forms, social platforms, or other communication tools.

You are solely responsible for ensuring that all messages, campaigns, automations, contact lists, consent records, opt-in processes, opt-out processes, disclosures, and communication practices comply with applicable laws and platform rules.

This may include laws and rules relating to email marketing, SMS messaging, telemarketing, call recording, data privacy, consumer consent, unsubscribe rights, and industry-specific requirements.

You must not upload, purchase, import, or message contacts unless you have the necessary rights, permissions, and lawful basis to do so. You must promptly honor unsubscribe, opt-out, stop, do-not-call, deletion, and similar requests.

StreamlineFlow may limit, suspend, or block messaging features if we detect abuse, complaints, high bounce rates, spam signals, carrier violations, legal risk, or suspicious sending behavior.

8. Customer Data and Lead Data

You retain ownership of the customer data, lead data, contact information, business records, messages, files, campaign content, and other information you submit to StreamlineFlow.

You grant StreamlineFlow a limited right to access, process, store, transmit, display, and use your data only as necessary to provide, maintain, secure, improve, and support the services.

You are responsible for ensuring that your collection and use of customer data is lawful and that you have obtained all necessary consents, notices, rights, and permissions.

You are responsible for exporting or backing up your important business data. While we may provide data storage and platform access, we do not guarantee that data loss, deletion, corruption, or unavailability will never occur.

9. Privacy

Your use of StreamlineFlow is also subject to our Privacy Policy. The Privacy Policy explains how information may be collected, used, stored, shared, and protected.

By using StreamlineFlow, you agree that we may handle information in accordance with our Privacy Policy and applicable law.

10. Subscriptions, Trials, and Billing

Certain StreamlineFlow services may require a paid subscription. Pricing, billing cycles, included features, user limits, trial terms, and add-on fees may be displayed on the website, checkout page, order form, invoice, or subscription agreement.

By starting a paid plan, trial, or subscription, you authorize StreamlineFlow or its payment processor to charge the payment method you provide for applicable fees, taxes, renewal charges, add-ons, usage-based charges, and other amounts due.

Unless otherwise stated, subscriptions renew automatically at the end of each billing period until canceled. You are responsible for canceling before the renewal date if you do not want to continue the subscription.

Trial offers may be limited to eligible users and may be modified, withdrawn, or restricted at any time. If a trial converts into a paid subscription, billing may begin according to the terms shown at signup.

11. Payment Failures

If your payment method is declined, expired, invalid, or unavailable, we may notify you and attempt to collect payment again. We may suspend, limit, or terminate access to paid features if payment is not received.

You remain responsible for all fees incurred before cancellation, suspension, or termination.

12. Refunds and Cancellations

Unless a separate written agreement states otherwise, fees are non-refundable once charged. Canceling a subscription stops future billing but does not automatically entitle you to a refund for prior charges, unused time, setup work, configuration, add-ons, or services already delivered.

If your plan allows continued access until the end of the billing period, you may continue using eligible features until that period expires.

Any refund exception must be approved by StreamlineFlow in writing.

13. Changes to Pricing, Plans, and Features

StreamlineFlow may update pricing, plan structure, included features, usage limits, add-ons, free trial offers, user fees, and billing terms from time to time.

If a change materially affects your paid subscription, we may provide notice through email, account notification, website update, invoice notice, or other reasonable method. Continued use after changes take effect means you accept the updated terms.

14. Third-Party Services and Integrations

StreamlineFlow may connect with third-party tools, applications, platforms, communication providers, payment processors, calendar systems, website tools, social platforms, analytics tools, email services, SMS providers, phone providers, automation tools, and other external services.

Your use of third-party services may be subject to separate terms, privacy policies, fees, limits, and rules set by those providers. StreamlineFlow is not responsible for third-party service outages, errors, data handling, pricing, policy changes, account restrictions, or platform decisions.

You authorize StreamlineFlow to share, transmit, or receive data with connected third-party services as needed to provide integrations and platform functionality.

15. Service Availability and Maintenance

We aim to keep StreamlineFlow available and functional, but we do not guarantee uninterrupted, error-free, or continuous access. The platform may be unavailable due to maintenance, updates, technical issues, third-party outages, internet problems, security events, force majeure events, or other causes.

We may modify, pause, remove, restrict, or discontinue any feature, integration, tool, or service at any time.

StreamlineFlow is not responsible for business losses, missed opportunities, lost leads, communication delays, or other damages caused by service interruptions, configuration issues, user error, or third-party failures.

16. User Content

You may upload, submit, create, send, store, or publish content through StreamlineFlow, including messages, campaign copy, website content, images, brand materials, customer records, lead notes, forms, reviews, automations, templates, and other business content.

You represent that you have the legal right to use and submit all such content and that it does not violate any law, contract, privacy right, intellectual property right, or third-party right.

You grant StreamlineFlow a limited license to use your content as needed to operate, deliver, secure, support, and improve the services. This license does not transfer ownership of your content to StreamlineFlow.

We may remove, disable, or restrict content if we believe it violates these Terms, applicable law, third-party rights, platform policies, or creates risk.

17. Intellectual Property

StreamlineFlow, including its website, platform, software, user interface, designs, branding, workflows, AI configurations, templates, documentation, content, logos, graphics, trade names, service marks, and underlying technology, is owned by StreamlineFlow or its licensors.

You receive a limited, non-exclusive, non-transferable, revocable right to access and use StreamlineFlow only according to these Terms and your subscription.

You may not copy, resell, sublicense, distribute, reverse engineer, modify, exploit, or create derivative works from StreamlineFlow technology, branding, software, content, or platform materials without written permission.

18. Feedback and Suggestions

If you send us feedback, ideas, suggestions, comments, improvements, feature requests, or recommendations, you allow StreamlineFlow to use them without restriction, compensation, confidentiality obligation, or obligation to implement them.

19. Confidentiality

During your use of StreamlineFlow, either party may receive non-public business, technical, financial, operational, customer, or platform information from the other party.

Each party agrees to use reasonable care to protect confidential information and to use it only for the purpose of performing under these Terms. Confidential information does not include information that is publicly available, independently developed, lawfully received from a third party, or required to be disclosed by law.

20. Security

StreamlineFlow may use administrative, technical, and organizational safeguards designed to protect platform security. However, no system can be guaranteed to be completely secure.

You are responsible for maintaining secure passwords, controlling user access, removing former employees or contractors from your account, configuring permissions properly, and using reasonable security practices.

You must promptly report suspected vulnerabilities, unauthorized access, account compromise, or misuse.

21. Prohibited Resale and Unauthorized Commercial Use

You may not resell, rent, lease, white-label, sublicense, commercially exploit, or provide access to StreamlineFlow to third parties unless StreamlineFlow has given written permission or your agreement expressly allows it.

Agencies, consultants, and service providers using StreamlineFlow for client work must ensure that their use is permitted under their subscription or written agreement.

22. No Professional Advice

StreamlineFlow may provide automation, AI-generated outputs, marketing support, reporting, analytics, recommendations, and communication tools. These are provided for business support only.

StreamlineFlow does not provide legal, financial, tax, medical, accounting, compliance, or professional advice. You are responsible for obtaining advice from qualified professionals where needed.

23. Business Results Disclaimer

StreamlineFlow is designed to help improve lead management, communication, automation, scheduling, and marketing workflows. However, results vary based on your industry, offer, pricing, market, competition, staff response, advertising budget, website quality, configuration, data quality, and other factors.

We do not guarantee any specific number of leads, calls, booked jobs, sales, revenue, rankings, reviews, conversion rates, return on investment, or business outcomes.

24. Termination and Suspension

You may stop using StreamlineFlow at any time. If you have a paid subscription, cancellation must be completed through the applicable billing process or by contacting support as instructed.

StreamlineFlow may suspend or terminate access if:

  • You violate these Terms
  • Payment is not received
  • Your use creates risk to StreamlineFlow, users, third parties, or systems
  • We detect fraud, abuse, spam, security threats, or unlawful activity
  • We are required to do so by law or third-party platform rules
  • Your account remains inactive or unsupported under current service policies

After termination, your access may end immediately. Certain obligations, including payment obligations, intellectual property restrictions, confidentiality, disclaimers, indemnification, and liability limitations, will continue after termination.

25. Data After Termination

After account cancellation, suspension, or termination, your access to account data may be limited or removed. We may retain certain information as required for legal, accounting, security, fraud prevention, dispute resolution, or operational purposes.

You are responsible for exporting needed data before your subscription ends, where export tools are available.

26. Indemnification

You agree to defend, indemnify, and hold harmless StreamlineFlow, its owners, officers, employees, contractors, affiliates, service providers, and partners from claims, damages, losses, liabilities, penalties, costs, and expenses arising from:

  • Your content, data, campaigns, messages, or customer communications
  • Your use of third-party integrations
  • Your failure to obtain consent for marketing or communications
  • Your infringement or alleged infringement of third-party rights
  • Any dispute between you and your customers, leads, staff, contractors, or business partners

27. Disclaimer of Warranties

StreamlineFlow is provided on an "as available" and "as provided" basis. To the fullest extent allowed by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, and uninterrupted operation.

We do not guarantee that the platform will be error-free, secure, continuously available, compatible with every system, or suitable for every business purpose.

28. Limitation of Liability

To the maximum extent permitted by law, StreamlineFlow and its related parties will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, including loss of profits, revenue, business opportunities, goodwill, data, leads, customers, or anticipated savings.

To the extent any liability cannot be excluded, StreamlineFlow's total liability for all claims relating to the services will be limited to the amount you paid to StreamlineFlow for the service giving rise to the claim during the three months before the event that caused the claim, or one hundred U.S. dollars, whichever is greater.

Some jurisdictions do not allow certain exclusions or limitations, so some parts of this section may not apply to you. In those cases, liability will be limited to the fullest extent permitted by law.

29. Dispute Resolution

Before filing a legal claim, you agree to first contact StreamlineFlow and attempt to resolve the dispute informally. Both parties agree to make a good-faith effort to resolve disputes through communication before pursuing formal proceedings.

If a dispute cannot be resolved informally, the parties agree to follow the dispute process, governing law, and venue stated in the final legal version of these Terms.

Governing Law and Venue: [Insert governing state/country and court venue after legal review.]

30. Force Majeure

StreamlineFlow will not be responsible for delays, failures, interruptions, or inability to perform caused by events outside our reasonable control, including natural disasters, power failures, internet outages, labor disputes, government actions, cyberattacks, war, terrorism, pandemics, supply chain interruptions, third-party platform outages, or communication carrier failures.

31. Changes to These Terms

We may update these Terms from time to time. Updated Terms may be posted on the website or made available through the platform. The revised version will become effective when posted unless a later date is stated.

Your continued use of StreamlineFlow after updated Terms become effective means you accept the revised Terms. If you do not agree, you must stop using the services.

32. Severability

If any part of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will continue in full effect. The invalid provision will be replaced or interpreted in a way that most closely reflects the original intent while remaining enforceable.

33. Assignment

You may not assign or transfer your rights or obligations under these Terms without written permission from StreamlineFlow. StreamlineFlow may assign these Terms as part of a merger, acquisition, restructuring, sale of assets, or business transfer.

34. Entire Agreement
